Labor Certification (PERM) – Not Required for EB1
For the EB2 and EB3 categories, the next step is the Labor Certification or PERM process. Staffigo will file an application with the Department of Labor (DOL) demonstrating that there are not enough able, willing, and qualified U.S. workers available to fill the position being offered at the prevailing wage. Once the Labor Certification is approved (or if you’re applying under EB1), Staffigo will file an Immigrant Petition for Alien Worker (Form I-140) with the USCIS. Adjustment of Status (Form I-485) or Consular Processing
When the I-140 petition is approved and a visa number is available, you can apply for Adjustment of Status (Form I-485) if you are already in the U.S, or for consular processing if you are outside the U.S. This is the final step in the Green Card process.
